Terms and Conditions

The agreement between you and Kryon Jobs covering use of the platform, the limits of our role in hiring, and the responsibilities each party accepts.

1. Who we are

Kryon Jobs is a recruitment and verified talent marketplace platform, operated by the company that owns and runs the Kryon Jobs service ("Kryon Jobs", "we", "us", "our"). We are incorporated in India. Our full corporate identity and registered address are available on request from support@kryonjobs.com, and appear on any invoice we issue to you.

In these terms, "platform" means the Kryon Jobs website, web application, mobile application, and application programming interfaces. "You" means the individual or organisation using the platform.

2. Acceptance of these terms

These Terms and Conditions form a binding agreement between you and us. By creating an account, posting a job, submitting an application, or otherwise using the platform, you confirm that you have read and accept these terms, and that you have authority to accept them on behalf of any organisation you represent.

You agree that acceptance given electronically, including by ticking a consent box or by continuing to use the platform, is valid and enforceable under section 10A of the Information Technology Act, 2000. We may retain a record of the version of these terms you accepted and the date of acceptance.

Your use of the platform is also governed by our Privacy Policy, which forms part of this agreement. If you do not agree with any part of these terms, you must stop using the platform.

3. Eligibility and your account

  • You must be at least 18 years old and competent to contract under the Indian Contract Act, 1872.
  • You must provide accurate, current, and complete information, and keep it up to date.
  • You are responsible for keeping your password confidential and for activity under your account, except to the extent the activity results from our own failure to secure the platform.
  • You must not share, sell, or transfer your account, and you must not create an account for another person without their written authority.
  • You must notify us promptly at support@kryonjobs.com if you suspect unauthorised access to your account.

We may refuse, suspend, or remove an account where we reasonably believe these terms have been breached, subject to the process in section 18.

4. Our role: an intermediary, not an employer

We provide a technology platform that allows candidates and employers to find one another. We act as an intermediary within the meaning of section 2(1)(w) of the Information Technology Act, 2000, in respect of information published by users, and we rely on the exemption from liability in section 79 of that Act. This distinction matters, so please read it carefully:

  • We are not an employer, employment agency, staffing firm, recruiter, or agent of any user, and we are not a party to any employment, contracting, or engagement agreement between a candidate and an employer.
  • We do not guarantee that any candidate will receive an interview, an offer, or employment, or that any employer will find a suitable candidate, receive a response, or fill any role.
  • We do not initiate transmissions by users, select the receiver of a transmission, or select or modify the information contained in a user transmission, other than automated formatting and the moderation described in section 5.
  • We do not participate in or supervise interviews, negotiations, offers, salaries, contracts, background checks, onboarding, work performance, workplace conduct, or terminations.
  • Job postings, company profiles, resumes, and all other user content are created by users. We do not endorse, adopt, or independently confirm the truth of any of it.
  • Any decision to apply for a role, to interview a candidate, to make or accept an offer, or to enter into any agreement is made by you, on your own judgement and at your own risk.

You are responsible for the due diligence you consider appropriate before dealing with another user, including verifying identity, credentials, references, right to work, and the legitimacy of any offer.

5. Verification and moderation are not guarantees

Some documents, company details, and job postings carry a verification or moderation status. That status records only that a review step was carried out against the information supplied to us at that time, and that the posting was screened against the prohibited content list in section 9.

A verified or approved label is not a warranty, certification, endorsement, or guarantee by us of any person, organisation, qualification, document, job, or opportunity. It does not mean we have confirmed the accuracy of the underlying information. Carrying out this moderation does not make us the author or publisher of user content, and does not affect our status as an intermediary under section 4.

Never pay to get a job.

Genuine employers do not ask candidates for fees, deposits, or payment for equipment, training, or placement. If you are asked for money, do not pay. Report it to us at support@kryonjobs.com and, where you believe an offence has been committed, to your local cyber crime authority.

6. Candidate obligations

If you use the platform as a candidate, you represent and warrant that:

  • Every detail in your profile, resume, and uploaded documents is truthful, accurate, and your own.
  • You hold the qualifications, certifications, and experience you claim, and you have the legal right to work in the locations you apply to.
  • You have the right to upload each document you submit and to allow employers you apply to to receive a copy of it.
  • You will respond honestly to employers and to interview invitations.

Submitting forged documents or another person's information is a serious breach of these terms, and may be reported to the affected employers and to the appropriate authorities.

7. Employer obligations and data protection

If you use the platform as an employer or hiring team, you represent, warrant, and undertake that:

  • You are authorised to represent the organisation named on your account and to post the roles you publish.
  • Every posting describes a genuine, currently available opportunity, and its details, including salary range, location, work mode, and requirements, are accurate.
  • Your postings and hiring process comply with applicable employment, equal opportunity, anti-discrimination, data protection, and labour laws.
  • You will never ask a candidate for payment of any kind as a condition of applying, interviewing, or being hired.
  • You will use candidate data only to evaluate that candidate for the role applied to, or for roles they have made themselves discoverable for, and you will not sell it, publish it, or transfer it to a third party without a lawful basis.
  • You will keep candidate data secure, apply appropriate technical and organisational measures, and delete or return it when your lawful purpose ends.
  • You will notify us without undue delay of any personal data breach affecting candidate data you obtained through the platform.

In respect of candidate personal data you receive through the platform, you act as an independent data fiduciary or controller in your own right, and not as our processor. You are responsible for your own compliance, including issuing your own notices to candidates and answering their rights requests. You will indemnify us under section 17 for claims arising from your handling of that data.

8. Content you submit

You keep ownership of the content you submit, including your resume, documents, profile details, job postings, and logos. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt for formatting and display, and transmit that content solely to operate and provide the platform to you and to the users you direct it to. This licence is sublicensable only to our hosting, storage, and delivery providers acting on our instructions, and for no other purpose.

The licence ends when you delete the content, except for copies already lawfully received by an employer, copies retained in routine backups until they are overwritten, and copies we must keep by law.

You warrant that you own the content or hold all necessary rights to it, and that it does not infringe any third-party right, breach any confidentiality obligation, or contain unlawful material.

9. Prohibited content and conduct

You must not host, display, upload, publish, transmit, store, update, or share any information that:

  • Belongs to another person and to which you do not have any right.
  • Is obscene, paedophilic, invasive of another person's privacy including bodily privacy, insulting or harassing on the basis of gender, racially or ethnically objectionable, or otherwise inconsistent with or contrary to the laws in force.
  • Is harmful to a child.
  • Infringes any patent, trademark, copyright, or other proprietary right.
  • Deceives or misleads the addressee about the origin of the message, or knowingly and intentionally communicates any misinformation or information which is patently false or untrue.
  • Impersonates another person.
  • Threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign States, or public order, or causes incitement to the commission of any cognisable offence, or prevents investigation of any offence, or is insulting to any foreign State.
  • Contains a software virus or any other computer code, file, or program designed to interrupt, destroy, or limit the functionality of any computer resource.
  • Violates any law for the time being in force.

In addition, and specific to this platform, you must not:

  • Post false, fraudulent, or non-existent jobs, profiles, or credentials.
  • Advertise multi-level marketing schemes, unpaid work presented as employment, or any training, placement, or equipment offer that requires a candidate to pay.
  • Scrape, crawl, harvest, or bulk-download candidate data, job data, or any other part of the platform by automated means.
  • Attempt to gain unauthorised access to any account, server, or data, probe or test the vulnerability of the platform, or bypass any access control or rate limit.
  • Reverse engineer or decompile the platform, except to the extent this restriction is prohibited by law.
  • Resell, sublicense, or make the platform available to a third party, or use it to build a competing service.

10. Grievance Officer, complaints, and content takedown

In accordance with rule 3(2) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, our Grievance Officer is:

Write to support@kryonjobs.com, marking your message for the attention of the Grievance Officer. Written correspondence may be sent to our registered office in India, the address of which is available on request from the same address. We act on grievances on working days.

You may complain to the Grievance Officer about content on the platform, about the conduct of another user, or about our handling of your account. We will acknowledge your complaint within 24 hours and dispose of it within 15 days of receipt. Complaints about content that exposes a person in a sexual act, or in nudity or impersonation including artificially altered images, will be actioned within 24 hours.

On receipt of an order from a court of competent jurisdiction, or a notification from an appropriate government agency under section 79(3)(b) of the Information Technology Act, 2000, we will remove or disable access to the offending material within 36 hours. We may also remove content ourselves where we reasonably believe it breaches section 9, and we will inform the user who posted it, with reasons, and give them an opportunity to dispute the removal.

11. Fees, invoices, and refunds

Some features are available only under a paid subscription plan. Fees, billing periods, and included limits are those stated on your plan at the time of purchase. Fees are payable in advance and are exclusive of applicable taxes, which you are responsible for.

Except where these terms or applicable law provide otherwise, fees are non-refundable. However:

  • If we terminate or materially reduce your paid plan other than for your breach, we will refund the unused portion of your fees on a pro-rata basis.
  • Nothing in this section limits any refund or remedy you are entitled to under the Consumer Protection Act, 2019, or other applicable law.

We may change our pricing on at least 30 days' notice, taking effect from your next billing period. If an invoice remains unpaid after we have given you notice and a reasonable opportunity to settle it, we may suspend or downgrade access to paid features.

12. Intellectual property

The platform, including its software, design, interfaces, text, graphics, and the Kryon Jobs name and logo, is owned by us or our licensors and is protected by intellectual property law. We grant you a limited, revocable, non-exclusive, non-transferable licence to use the platform for its intended purpose while your account is in good standing. All rights not expressly granted are reserved.

If you send us feedback or suggestions, you agree we may use them without restriction or obligation to you.

13. Third-party services

The platform relies on third-party services, including cloud hosting and storage, email and SMS delivery, font and script delivery networks, and social sign-in with Google, LinkedIn, and GitHub. It may also link to third-party sites. Those services operate under their own terms, and except where we are responsible for our own choice and instruction of a provider, we are not responsible for their availability, content, or acts and omissions.

14. Availability of the service

We aim to keep the platform available, but we do not promise uninterrupted or error-free operation. We may modify, suspend, restrict, or discontinue any feature at any time. Where a change is material and adverse to a paying subscriber, we will give reasonable notice and the pro-rata refund described in section 11.

You are responsible for retaining your own copies of anything you upload. We do not offer a backup or data recovery service to users.

15. Disclaimer of warranties

To the fullest extent permitted by law, the platform and all content on it are provided "as is" and "as available", without warranty of any kind, whether express, implied, or statutory. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, title, accuracy, and non-infringement.

We make no warranty that the platform will meet your requirements, that it will be secure, timely, uninterrupted, or error-free, or that any content, job posting, employer, candidate, credential, or opportunity on the platform is accurate, genuine, lawful, or suitable.

Nothing in this section affects rights and guarantees that cannot be excluded under applicable law, including under the Consumer Protection Act, 2019. Where an implied warranty cannot be excluded, it is limited to the minimum extent that law permits.

16. Limitation of liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for wilful misconduct, or for any other liability that cannot lawfully be excluded or limited. Nothing in this section affects your rights as a consumer under the Consumer Protection Act, 2019.

Subject to that, and to the fullest extent permitted by law, we will not be liable to you for:

  • Any indirect, incidental, special, or consequential loss.
  • Loss of profit, revenue, business, goodwill, opportunity, anticipated savings, or reputation.
  • Loss or corruption of data, other than loss caused by our failure to take the security measures described in our Privacy Policy.
  • Any act, omission, conduct, or content of any user, employer, candidate, or third party, whether online or offline.
  • Any employment decision, offer, withdrawal, rejection, termination, salary, contract, or workplace dispute.
  • Any fraud or misrepresentation carried out by a user of the platform, provided we have complied with our obligations in section 10.

Subject to the first paragraph of this section, our total aggregate liability arising out of or in connection with these terms or your use of the platform, whether in contract, tort including negligence, statute, or otherwise, is limited to the greater of (a) the total fees you paid us in the twelve months immediately before the event giving rise to the claim, or (b) INR 25,000.

If any exclusion or limitation in this section is held to be unenforceable, it will apply to the maximum extent permitted by law, and the remaining exclusions and limitations will continue to apply.

17. Indemnity

You agree to indemnify and hold harmless Kryon Jobs, its directors, employees, and agents from and against all claims, proceedings, losses, damages, penalties, and reasonable legal costs arising out of or connected with:

  • Content you submit, post, or transmit.
  • Your breach of these terms or of any applicable law.
  • Your infringement of any third-party right, including intellectual property and privacy rights.
  • Any dispute between you and another user, including any employment or contractual dispute.
  • Your handling of candidate or employer personal data received through the platform.

This indemnity does not apply to the extent the claim arises from our own negligence, wilful misconduct, or breach of these terms. We will notify you promptly of any claim, will not settle it without your consent where the settlement admits your fault or imposes an obligation on you, and will give you reasonable opportunity to participate in the defence at your cost.

18. Suspension and termination

You may close your account at any time. We may suspend or terminate your access where we reasonably believe you have breached these terms, created legal exposure for us or our users, or engaged in fraudulent or unlawful conduct, or where we are required to do so by law.

Except where immediate action is necessary to prevent harm, to comply with a legal order, or where the breach is not capable of remedy, we will give you notice and a reasonable opportunity to remedy the breach before terminating. Where we act immediately, we will tell you the reason as soon as reasonably practicable, and you may challenge the decision through the Grievance Officer in section 10.

On termination, your licence to use the platform ends. Sections 8 (as to licences already granted), 11, 12, 15, 16, 17, 20, and 21, and any other provision intended to survive, will remain in force.

19. Changes to these terms

We may update these terms. Where a change is material, we will give at least 15 days' notice in the application or by email before it takes effect, and we will publish the revised version with a new version number and effective date. Continuing to use the platform after a change takes effect means you accept it. If you do not accept it, you may close your account, and if you are a paying subscriber you may claim the pro-rata refund described in section 11.

20. Governing law and disputes

These terms, and any dispute or claim arising out of or in connection with them, including non-contractual disputes, are governed by the laws of India.

Before starting proceedings, please raise the matter in writing with our Grievance Officer under section 10 and allow 30 days for us to try to resolve it in good faith. This step is a request, not a bar to your right to approach a court or forum.

Subject to the paragraph below, the courts having jurisdiction at the place of our registered office in India have exclusive jurisdiction, and you submit to that jurisdiction.

If you are a consumer, nothing in these terms affects your right to bring proceedings before the consumer forum having jurisdiction under the Consumer Protection Act, 2019, including at the place where you reside or work, or your right to join a complaint brought on behalf of consumers having the same interest. Nothing in these terms shortens any limitation period prescribed by the Limitation Act, 1963.

21. General provisions

  • Entire agreement. These terms, the Privacy Policy, and any plan terms you accept are the entire agreement between you and us on this subject.
  • Severability. If any provision is held unenforceable, it will be modified to the minimum extent necessary, or severed, and the remaining provisions continue in full force.
  • No waiver. A failure to enforce a provision is not a waiver of the right to enforce it later.
  • Assignment. You may not assign these terms without our written consent. We may assign them as part of a merger, acquisition, or sale of assets, on notice to you.
  • No partnership. Nothing here creates a partnership, joint venture, agency, or employment relationship between you and us.
  • Force majeure. Neither party is liable for a failure or delay caused by events beyond its reasonable control, provided it takes reasonable steps to mitigate.
  • Notices. We may give notice to the email address on your account. You may give notice to the addresses in sections 10 and 22.
  • Language. These terms are made in English, which governs their interpretation.
